AUSSIEFRIENDS
TERMS AND CONDITIONS

    1. General
    1.1 This agreement is a legal document and creates a binding contract between you and Aussie Friends.
    1.2 Please read these terms and conditions carefully.
    1.3 This agreement sets out the terms and conditions ("Terms") under which we provide Aussie Friends services to you. By registering with Aussie Friends you become a member of the service ("Member") and you agree to be bound by the Terms for as long as you continue to be a Member. If you do not agree to the terms please do not register for the Aussie Friends service.
    1.4We reserve the right to alter or update the Terms from time to time including fees payable. We will provide notice to you of such changes by means including, without limitation, posting on the Aussie Friends website or by email. Any changes will be effective 14 days from the date of posting the notice or sending the email or otherwise giving the notice, unless you notify us during those 14 days that you do not wish to continue to be a Member. Your use of this service after such time will be deemed acceptance of the changes.
    1.5 In becoming a Member you accept that you utilise the services of Aussie Friends at your own risk.

    2. Registration
    2.1 To become a Member you must register with us by providing accurate, current and complete information about yourself as prompted by the registration form and pay the fee payable for the particular membership as required. The Member must maintain and update all information provided to keep it accurate, current and complete.
    2.2 Payment can only be made by way of credit card. When asked for credit card details you must undertake that you are:
    (1) authorised to use the card, and
    (2) it has available funds sufficient to cover the charges.

    3. Membership Fees and Rules
    3.1 The Member acknowledges the membership fees paid as required by this contract are completely non refundable except as required by law.
    3.2 The Member acknowledges that if information is untrue, inaccurate, not current or is incomplete in any respect, we reserve the right to suspend or terminate the Members membership without notice to the Member.
    3.3 The Member must not collect, use or disclose personal information about any other member for any reason without their express consent.
    3.4 The Member may upgrade to a higher grade of membership on payment of the fee payable for that upgrade.
    3.5 By submitting material to the Aussie Friends service, you must be fully entitled to do so.

4. Membership
4.1 There are two classes of membership available:
(1) Casual Membership: Casual Membership entitles the Member to the following services:
(a) the posting of name and personal details (not including address or email address) on the Aussie Friends site;
(b) Receiving email messages from VIP Members to the email address provided during registration.
(c) Receive emails from Aussie Friends on new or extra services.
(2) VIP Membership: VIP Membership entitles the Member to Causal Members services and in addition:
(a) Sending email messages to both standard and full members;
(b) Entering any reunion details for their school or college or request Aussie Friends send an email invitation to their Members registered to that school or college for the means of attending a reunion.
(c) Posting to any message boards which may be available on the Aussie Friends website.

    5. Member Acknowledgement
    5.1 The Member acknowledges that services provided by Aussie Friends are based solely on information provided by the Member.

    6. Information Provided by Members
    6.1 Aussie Friends accepts no responsibility for any inaccuracies or other defects in the provision or use of information provided by the Member.

    7. Additional Services
    7.1 Upon the introduction of new or additional services Aussie Friends may apply additional terms and conditions. As mentioned, we will provide you with 14 days notice of these changes and or additions. If you do not notify Aussie Friends during that 14 days period your silence will be taken as acceptance of these new terms and conditions.

    8. Termination of Agreement
    8.1 Aussie Friends has the right to terminate this agreement effective immediately if, in its reasonable opinion, the Member has conducted themselves in a way which may bring Aussie Friends into disrepute, or in a way which may offend any other Member.

    9. Screening of Material
    9.1 Members should be aware that Aussie Friends does not pre-screen or monitor the material contributed by Members. If you see anything which in your opinion is, false, unreliable, misleading, obscene or pornographic please report it to us by emailing support@aussiefriends.com so we may take appropriate action.

    10. Indemnity
    10.1 Aussie Friends is not liable to the Member under any circumstances for any direct, indirect or consequential loss or damage arising out of the use of the Aussie Friends service and the Member releases Aussie Friends (and its officers, employees, contractors, servants and agents) from all liability for loss, damage, liabilities, costs and expenses which may be suffered, incurred or awarded against Aussie Friends as a result of:
    (1) the conduct of any person introduced to the Member through Aussie Friends; or
    (2) any other damages suffered by the member as a result of using the services of Aussie Friends.
    10.2 The Member indemnifies Aussie Friends (and its servants and agents) against any loss, damage, liabilities, costs, and expenses, which may be suffered, incurred or awarded against Aussie Friends as a result of:
    (1) a breach by the Member of any of their obligations under these Terms; or
    (2) Any information provided by the Member being false, misleading or inaccurate.

    11. Withdrawal/Modification of Service
    11.1 We reserve the right to withdraw or modify the Aussie Friends service, or any part of it, at any time without notice and without liability to us where we have legal or technical reasons for doing so.

    12. Intellectual Property
    12.1 The Member acknowledges that all copyright, logos, trade marks and other intellectual property rights in and relating to the Aussie Friends service (including the material which is contributed by Members) is owned by Aussie Friends.

    13. Assignment
    13.1 We reserve the right to assign this agreement, and to assign or subcontract any or all of our rights and obligations under this agreement.

    14. Reporting Complaints
    14.1 The Member agrees to present any complaints in writing to Aussie Friends. Aussie Friends will in turn attempt to resolve any genuine disputes with the utmost good faith.

    15. Entire Agreement
    15.1 These terms constitute the entire agreement between the parties. Any prior arrangements, representations or undertakings are superseded.

    16. Governing Law
    16.1 These Terms are governed by the laws in the State of Queensland and the parties submit to the non-exclusive jurisdiction of the Courts of Queensland and the Federal Courts of Australia.

    We do not vouch for, warrant or take responsibility for the accuracy, completeness or usefulness of any message. The messages express the views of the author of the message, not necessarily the views of Aussie Friends or any entity associated with the Aussie Friends. Any user who feels that a posted message is objectionable is encouraged to contact us immediately by email, where we will endeavour to remove the message(s) in question within a reasonable time frame, if we determine that removal is necessary.

    You agree, through your use of this service, that you will not use the Aussie Friends to post any material which is knowingly false and/or defamatory, inaccurate, vulgar, hateful, harassing, obscene, profane, threatening, invasive of a person's privacy, or otherwise violative of any law. You agree not to post any copyrighted material unless the copyright is owned by you or this site. Although Aussie Friends does not and cannot review the messages posted and is not responsible for the content of any of these messages, we reserve the right to delete any message for any or no reason whatsoever. You remain solely responsible for the content of your messages, and you agree to indemnify and hold us harmless with respect to any claim based upon transmission of your message(s). We also reserve the right to reveal your identity (or whatever information we know about you) in the event of a complaint or legal action arising from any message posted by you. Please note that advertisements, chain letters, pyramid schemes, and solicitations are inappropriate in Aussie Friends.
